TERMS & CONDITION

The products for sale on www.giomila.com (hereinafter the “Site”) are sold and invoiced by ETERNO srl, situated in Via degli Artigiani, 30/32 – 50041 Calenzano (FI), a company registered with the Chamber of Commerce of Florence at no. GENERAL CONDITIONS OF SALE

Acceptance of the general conditions of sale and contract conclusion

1.A The contract stipulated between ETERNO srl. (“Hereinafter ETERNO”) and the Customer (who makes the purchase on the Site) must be considered concluded with the acceptance, even if only partial, of the order by ETERNO In case of non-acceptance of the order, ETERNO will promptly notify the Customer.

1.B After submitting the order, in every methods provided on the basis of the order form on the Site (hereinafter the “Order”), the Customer declares to have read and accepted all the information provided during the procedure of purchase, as well as these general terms and conditions (hereinafter the “Conditions”).

1.C These Conditions may be printed or saved on a durable medium, in compliance with the provisions of art. 12 of Legislative Decree 70/2003 and art. 51 of Legislative Decree 206/2005, as amended by Legislative Decree 21/2014. 21/2014.

How to purchase

2.A The products offered for sale by ETERNO are only those on the website www.giomila.com as described in the relevant information sheets.

2.B The images contained in the product data sheets have a purely informative function and may not be fully representative of the product, due to the browser and monitor used for accessing the Site and viewing the images.

2.C In order to place an Order, the Customer must fill in the relevant form on the Site, entering all the requested information, and send it after having read these Conditions, as well as the characteristics of the products which intends to purchase. The Customer must also specify any request for the issuance of a tax invoice for the purchase concluded, pursuant to art. 22 D.p.R. n. 633/1972. 633/1972.

2.D ETERNO will confirm the correct receipt of the Order by sending a specific e-mail to the e-mail address communicated by the Customer, in which the purchase conditions and the data entered in the Order by the Customer will be summarized.

Methods of payment

The payment methods are:

1- PayPal

PayPal The Paypal circuit can be used by the customer according to the specific procedures of the same.

2- Carta di credito

The information relating to the Customer’s credit card is transmitted via a secure connection directly to the website of the bank that manages the transaction. ETERNO’s archive will not keep sensitive data. ETERNO cannot be held responsible for any fraudulent and improper use of credit cards by third parties upon payment.

Products delivery and related costs

4.A The delivery of the purchased products will be made within 48 hours of acceptance of the Order by ETERNO, at the address indicated by the customer, at the cost specifically indicated on the Site before sending the Order. ETERNO reserves to accept or not deliveries requested outside Italy or Europe. In any case, for deliveries made outside the Italian borders, shipping costs and delivery times may vary.

4.B With reference to deliveries made outside European Union, any import customs fees will be borne by the recipient. The Customer is therefore invited to contact the customs authorities of their country in advance, to check the costs and any import limits.

4.C The import customs fees indicated by ETERNO are very clear. Once the order has been placed, Terms and Conditions of ETERNO are accepted. This means that once the Order has been placed, it does not entitle the Customer to refuse the goods and to claim compensation or refund due to the import customs fees of his country.

4.D The delivery times indicated by ETERNO must be considered as purely indicative. Any delay or any delivery made with subsequent split shipments, does not legitimize the Customer to refuse the goods and to request compensation or compensation.

4.E Upon delivery, the Customer is required to check that the number of packages corresponds to what is indicated in the transport document.

Any problems concerning the physical integrity, correspondence or completeness of the products received must be reported within 7 days of delivery, according to the procedures set out in this document.

Right of withdrawal

5.A Pursuant to art. 52 of Legislative Decree 206/2005, as amended by Legislative Decree 21/2014. 21/2014, the Customer may exercise the right of withdrawal within 14 (fourteen) days working from the date of receipt of the products.

5.B To exercise the right of withdrawal referred to the Article 5.A above, the Customer must send to ETERNO a communication with the specified terms, at customerservice@giomila.com, or by registered letter with return receipt addressed to Eterno s.r.l., Via degli Artigiani n. 30/32, 50041 – Calenzano (FI), Italy. For compliance with the deadline referred to point 5.A, Costumer has to consider the shipping date.
It is also possible to use the appropriate email on the Site.

5.C In case of withdrawal, the Customer must return the products to ETERNO within 14 (fourteen) days from the notice of withdrawal (reliable the shipping date), to the following address: ETERNO srl Via degli Artigiani 30/32 – 50041 Calenzano ( FI) Italy.
The goods must be returned intact, complete with all its parts and in the original packaging (envelopes and packaging), with no signs of wear or dirt.
The costs for the return are charged to the customer.
Any damage, theft, loss of goods occurring during or in any case depending on the return shipment remain the sole responsibility of the customer.

5.D Within 14 days of receipt of the goods, when the cases provided for in point 5.E below do not occur, Eterno will refund the Customer the full amount already paid, by means of a reversal of the amount charged, using bank transfer as means of payment to make the refund.

5.E The Customer will lose the right of withdrawal when ETERNO ascertains that:
– The returned item and / or its accessories, and / or its packaging were not intact;
– The returned item is missing its integral elements and / or accessories
– The item was missing its external packaging and / or internal packaging original.

– The item was found with signs of wear or dirt.

Privacy

The personal data collected with the order, will be processed by ETERNO only for satisfying the express requests of the Customer, in compliance with the European Regulation 679/2016 and the privacy information on the site. Any further processing will be carried out only with the express consent of the Customer.

Applicable law

The sales contract referred to in these Conditions and its execution are governed by Italian law, which regulates its conclusion, execution and termination, and on the basis of which it will be interpreted, also for the purpose of resolving disputes arising from it, with the non-application of the conflict rules and the United Nations Convention for the International Sale of Goods. The court of Florence will have exclusive jurisdiction to resolve the relative disputes.
